Legal: PRIMESERV.COM GUIDELINES
1. Content Guidelines. Customers of PrimeServ® are solely responsible for everything contained in their own Web page. PrimeServ is not responsible for the content of any Web page and does not verify, endorse or otherwise vouch for the contents of any Web page.
Customers of PrimeServ may be held legally liable for the contents of their Web page and may be held legally accountable if their Web page includes, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without express permission of the author or owner. The opinions and views expressed by customers of PrimeServ in their Web pages do not reflect those of PrimeServ. The content of the Web pages will not be reviewed prior to publication through PrimeServ's service. PrimeServ does not actively monitor the content of Web pages, but will investigate complaints of violations involving these guidelines or the Hosting Agreement. Customers of PrimeServ shall refrain from using PrimeServ's Web service for the following activities:
a. Displaying material containing nudity or pornographic material of any kind;
b. Providing material that is grossly offensive to the online community, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity;
c. Displaying material that exploits children under 18 years of age;
d. Promoting or providing instructional information about illegal activities, promoting physical harm or injury against any group or individual, or promoting any act of cruelty to animals;
e. Committing acts of copyright, trademark, patent, trade secret or other intellectual property infringement;
f. Defaming any person or group;
g. Developing home pages or session posts that consist of hyper links to content not allowed through PrimeServ's Web service;
h. Using PrimeServ Web service for the purpose of gathering personal information from individuals for or unlawful purposes.
If any customer of PrimeServ is in violation of these guidelines, the customer may have its services terminated and its page or portions of its page suspended or removed without warning in which event the removed page or pages will not be returned to the offending customer. PrimeServ is not responsible or liable for any loss of data resulting from its deletion of Web pages, network or system outages, file corruption or any other reasons. PrimeServ recommends that each customer maintain backup versions of its pages to guard against losses of any kind.

2. Warranties. NO WARRANTY OF ANY KIND IS MADE BY PRIMESERV REGARDING ANY INFORMATION, SERVICE OR PRODUCT PROVIDED THROUGH OR IN CONNECTION WITH ITS HOSTING SERVICE AND PRIMESERV EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: THE WARRANTIES OF DESIGN, ANY IMPLIED WARRANTIES AGAINST INFRINGEMENT OF THIRD PARTY PROPERTY RIGHTS, OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR ARISING FROM A COURSE OF DEALING, TRADE USAGE OR TRADE PRACTICE.
3. Limitation on Damages. PRIMESERV IN NO WAY SHALL BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND, RESULTING FROM ITS PERFORMANCE OR FAILURE TO PERFORM PURSUANT TO ITS HOSTING SERVICE. EACH CUSTOMER AGREES THAT NO CLAIMS SHALL BE MADE AGAINST PRIMESERV FOR DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, PROFIT, REVENUE OR GOOD WILL, WHETHER BASED IN CONTRACT, NEGLIGENCE, OR OTHERWISE, ARISING OUT OF, RESULTING FROM OR IN ANY WAY RELATED TO THIS AGREEMENT. EACH CUSTOMER AGREES TO INDEMNIFY AND HOLD PRIMESERV HARMLESS FROM ANY AND ALL LIABILITY OR EXPENSE, INCLUDING REASONABLE ATTORNEY FEES, ARISING OUT OF THIS AGREEMENT. NOTWITHSTANDING ANYTHING ABOVE TO THE CONTRARY, THE MAXIMUM AGGREGATE AMOUNT OF MONEY DAMAGES FOR WHICH PRIMESERV MAY BE LIABLE AS A RESULT OF ITS HOSTING SERVICES, RESULTING FROM ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO A SINGLE MONTH'S HOSTING FEE.
4. Assignment. A Hosting Agreement may not be assigned or transferred to any other person or entity without PrimeServ's written authorization.
